In our opinion, these guys are the
worst criminals
and crooks we've run across ever! Their laptops are way
"over priced" and from what we saw, in
our opinion, their laptops are junk. If
you are computer retailer, DO NOT take them up on their bogus offer to send
you a so called "DEMO" laptop "free" for 30 days, as you will find out, "it
ain't FREE and it ain't a "DEMO" either. Once they send it to you, YOU
BOUGHT IT! HOW do they do it? Simple, they just charge your
credit card or cut and paste your signature to a bank transfer form and then
send you an invoice stating: "ALL SALES ARE FINAL"!
after you return the laptop back to them.
A complete SCAM!!
Here's how they do
it.
Silicon Mobile Technology’s scam
tactics amount to out right "FRAUD". The last time I checked, this was
against the law. It starts with a call from Silicon's sales department.
They claim to be a manufacturer of high quality, low priced laptops.
The sales
call is to make it look like they want you to become a
Wholesale/Reseller vender of their laptops by sending you a
industry standard "credit application" so that "if" you are approved, you can then
purchase wholesale from them, in order to resell their laptops to the
public at retail. Retailer's receive sales calls like this all the
time. On the credit application, you are required to list a personal
or company credit card and credit card number. Silicon Mobile also
requires that you send them a "voided check". You also must "sign" the
credit application. None of this is out of the norm for the industry,
so of course everything appears absolutely normal at this point.
However, once this is done, all of the necessary pieces to de-fraud you are
in place and in the hands of Silicon Mobile.
You get sales calls like this all the time where distributors want you to
fill out a credit application and sell "their" products in your retail
store(s). The "catch" here is, in order to entice you to
buy their laptops for resale and fill out their resale credit application,
they say they are willing to ship you one of their laptops, free of charge (if
returned in a specific time frame). You are told this is a DEMO
laptop for you to "test", "evaluate" their quality and display in your
retail store for your customers to "see" it. You are assured by the
sales person that all you have to do is return the DEMO/EVALUATION laptop
after the 30-45 day trial period and you will not be charged for it.
You are told by the sales person that once you "see" or evaluate the quality
of their laptops, you will want to stock them and sell them to your
customers. This appears to make good business sense to "look over" the
manufacturer's laptops before you start buying them to stock in your store(s). After all Silicon Mobile doesn't have the name recognition
as IBM, SONY, COMPAQ, HP, etc.
So you
think "OK, I can look over their laptop, return it without being charged",
and go from there. So of course you agree to them sending you this DEMO/EVALUATION
laptop, returnable at no charge. You then fill out the credit
application, sign it and fax it and a copy of a voided check to Silicon
Mobile. You then sit back and wait for 2 things: 1). to receive the
DEMO laptop via UPS and 2). to see if your credit application is approved by
Silicon Mobile. This will most likely take a few days and you know
that.
Now, here's what happens
behind your back while you are waiting.
NO
CREDIT CHECK is ever performed by Silicon Mobile because they never intended
to check your credit.
The same day that Silicon Mobile receives your
fax, they charge your credit card for the full price of the so called DEMO
laptop. Yes, the same credit card number you put down on your credit
application. If the charge goes through, they then ship out the laptop
to you like as if it was a "sale".
They then write up a
bogus sales receipt and forge your signature on it.
Remember, you gave them all the necessary information
to write up a complete sales receipt including a copy of your signature when
you signed the credit application.
The "terms of the sale"
on the sales receipt says: "ALL SALES ARE FINAL". Of course being
unaware of what Silicon Mobile did, you sign for the laptop upon delivery by
UPS and the fraudulent transaction is now complete. Yes, you are now
the proud owner of a sub standard, over priced laptop.
Silicon Mobile is fraudulently selling their laptops in this
manner.
What happens from here varies from person to person
and company to company. Will you get your money back if you return the
laptop? Do you return the laptop? Do you keep it? Do you
call your credit card company to let them know you've been scammed? Do
you demand that they credit back the charges? Do you call Silicon
Mobile to find out what the **** is going on? At some point you will
find out that your credit card was charged for the DEMO laptop and you have
been scammed. You never authorized that charge, but whether you get your
money back depends on your credit card company. The "offer" for a 30 or 45 day
DEMO/EVALUATION laptop is verbal over the phone so you
can’t prove what they said. If you complain to your credit card
company, Silicon Mobile will try to
make it appear to your credit card company that you intended to buy the DEMO
and not merely accept the DEMO unit from them for a trial period of 30 to 45 days. This
was on their website (www.superlaptop.com)
that they will send you a DEMO if your application is approved, but nothing
about 30 or 45 days trial period. If you return the laptop per the
verbal agreement you made with them, Silicon Mobile will still keep your
money and the laptop. Not really a
particularly clever or creative scam, just one that they feel like they can
circumvent the law because they know it's to expensive for any individual
to fight a legal battle against them. How many other retail venders
have they scammed this way? Figure this: Get a sales department working the phones to
call all of the computer retail stores in America with the same offer and
even if they only get away with it 50% of the time, that adds up to a lot of
fraudulent laptop sales and a lot of money.
There is recourse thanks
to the way in which our laws read. If for example you can prove to
your credit card company that you never intended to buy the laptop, you may
get your money back. One point of law, and there are more, in regard
to a "sale" or "sales" concerns "intent". An example of
intent would be if you drove down to a store and bought
something. Intent is demonstrated by the act of you
purposely driving down to the store and not exclusive to the fact that you
bought anything. If your credit card company refuses to give you your
money back, then that's
where they are missing this particular point of law,
if they fail to determine your "intent". The faxed copy of their
application, for example, clearly demonstrates the lack of intent on your
part because is shows that they contacted you for a "different" or "other"
reason than to personally sell you a laptop. It also eliminates your
"intent" to buy a laptop from them for a couple of reasons. One,
clearly by them faxing you a application to become a "reseller" demonstrates
that they initiated the contact, that two, it demonstrates that your intent
was to get set up on "credit terms" and not to purchase a laptop from them.
Therefore, the criteria set forth by law, clearly is not met by your
"intent" to buy anything from them. That this was not
a "normal sale". If your credit card company does NOT give you your
money back, then they are
not taking into consideration "how" the information needed for Silicon Mobile to
commit
fraud is obtained. In dealing with your credit card company, you
need to make sure you are talking to someone with a tiny bit of knowledge of
law.

I have had a similar experience with this company!
My Computer company credit card was billed for a demonstration Laptop after
filling out a Credit Application Form with SiliconTop, likewise I am unable
to get my credit card company to reimburse my monies because Silicon Mobile
Technologies faxed my credit card company a fraudulent sales receipt that
had a forged signature upon it, with the words "All Sales Final" , I never
signed this form, nor had I ever seen this form before.
Please could you contact the individual who posted this story, and ask if he
would be interested in helping me?
I have contacted the Better Business Bureau in regards to this matter and
they have said that they have not had any similar complaints, and I am
hoping we could help each other recover our money!

Part 2 of Complaint:
Dear Sir,
In October 2002 my store 'Computer Corner" was approached by Silicon
Mobile Technology aka SiliconTop, with an offer to resell their Laptop
Computers; when they initially approached us they said we were to sell
their merchandise on a consignment basis within our store.
I promptly filled out the merchant agreement forms they sent to us, and
included a check from my business account marked "VOID" per their
request and sent it back to them. A couple of days later I received a
Laptop Computer from SiliconTop.
Although I placed the Laptop on display in the store, we were unable to
find a purchaser for it, so we contacted SiliconTop via Telephone and
requested a RMA number to return it to them. They faxed me a RMA form
which they had typed the sentence "Laptop needs to be in original
condition, and received by 10/15/02", and we returned the Laptop insured
via UPS as they requested.
When I received my monthly Credit Card statement I noticed the following
day after I had received the Laptop Computer they had charged the full
RETAIL price ($1507.00) of the Laptop Computer to my Credit Card
account.
I contacted SiliconTop promptly and spoke with one of their
representatives who told me that "All Sales are Final" , I said I had
never agreed to purchase the laptop, I had a consignment agreement with
Silicontop to sell them within my store.
I still at this point believed it was a genuine mistake on their part.
That was until they stopped returning my calls, and I was told every time
I contacted then "no one is available right now to help you" at this
point I was out $1507.00 for a Laptop Computer I had already returned,
and no refund was issued to me.
I contacted my Credit Cards "Risk Management" section and explained the
situation to them, they did a chargeback in the amount of $1507.00 and
suggested I change my Credit Card account number to stop any more
charges being placed upon the card by SiliconTop.
In August the $1507.00 credited to our bank account was once again
debited and returned to SiliconTop, when I contacted my Credit Card
Company they told me they had no claim against SiliconTop because I had
signed a sales receipt with the words "ALL SALES FINAL" upon it.
I told them I had signed no such document and requested they send us a
copy of this form, I was amazed to receive a form marked "SALES NO
CAPTURE" in the amount of $1507.00 with the words "ALL SALES FINAL" and
signed by myself!
I had not signed this form, actually I had never seen this document
before, under closer scrutiny I found that the signature on the "SALES
NO CAPTURE" form was transposed from the "Merchant Reseller" form I
signed and faxed to SiliconTop and they had used this to convince our
bank we purchased the Laptop.
They claimed this slip was sent to me via facsimile and that I then
signed and returned it to them, however it only has the Facsimile
headers from when they sent it to my bank, it does not show any signs of
a document exchanged by facsimile.
I am attempting to contact the other victim of "Silicon Mobile
Technology" fraudulent actions, I am hoping together we can recover our
monies!
I can provide documentation to support my claims, I did not receive an
email from you accepting my offer of documentation.

I use to be the store manager for a computer store, I use to get a call from
silicontop about once a month for 1-2 years about getting a DEMO unit in my
store for 30 days, well I ALWAYS told them NO because the laptop was way
over priced. Well after I quit my boss started doing all the buying for the
stores. He got contacted and made the mistake of getting one(June/July
2004). The laptop came in and sat on the shelf for 60 days before they
called and asked when we were going to send it back. Well since we had not
had ANYBODY want to buy this over priced laptop we told them to give us the
info and we would send it back. Two days latter they called and got a
tracking number for the return. About 2 weeks latter we get a call from the
bank because checks start bouncing. Come to find out that the same day that
they got the tracking number they charged the bank for the laptop. well we
got that reversed, 1-2 weeks later they charged the account again..
Reversed. 1-2 week later the!
y charged 4 payments of $500... 1-2 weeks later they some how go a hold of
his personal bank account number and also charged it four $500 withdraws. We
have had over 50 checks bounce because of the scam, and have had to cancel
ALL bank accounts at that bank and get 2 Credit Cards replaced. I know for a
fact that they just called the store today (12-21-04) and from the sounds of
it they had him on speaker phone so they could record the call and use it
against the store as well. I know that the owner has been in talks with BBB
and this lawyer about this but don't know a hole lot more about it..
Simply put same scam different way of doing it now. |

Complaint: this is about silicon mobile, same deal , i am a small computer
retailer in concord, nc and was contacted by david at silicon mobile, he
wanted me to sell his computers in my store front and pay after they were
sold or in 45 days. he asked for a cancelled check to send laptop, so i
faxed a copy of a company check. i got the laptop in 5 days. i could not
sell the overpriced computer, so i called david, in which he answered the
phone by a different company name, i told him that i could not sell the
machine so he said i could have 15 more days, i told him that i am selling
dells for $699 so to try to sell his crap at cost ,$1298.00 was impossible,
so i wanted to return, he said that i couldn't cause it was too long and
past the 30 days, which he said he would give me 15 more days, so he sent
fedex to pick up machine, which i sent back like he asked, well 2 days later
i find a draft withdrawn from my account for $1298.00 without my signature
not required. then i called!
d and asked him where my money was, well he doesn't call back , he faxes me
a letter to say that the computer was not in the original box, it was a box
inside of a box, that was on the outside of the box that the computer was
in, then he claims there's some fees of $260 for restocking and fedex, and
that he wanted the original outside box ,and claimed that i didn't send the
case that it came with, mean while i bought 8 laptop cases from him several
moths ago, so that was the case i sent with the computer, instead of taking
the $260 out of the $1298.00 that he fraudulently took from me he thinks my
dumb ass is gonna send him another check, this has cost me so much grief
that i had to change my checking account so he cant use it again, this is
what help i got from my bank. this company is a fraud and they have several
different names that they go by, he also sells herbs.which i think he smoked
too much of. i hope that some day someone can do something( like the
government) to a__ __ holes like this. i don't know about you but this is a
lot of money and I work very hard for my money and some people are honest
and some ain't(silicon mobile tech inc.)i hope he rots in hell for ripping
people off god bless the little man.if you have been ripped by this guy call
me at 704-786-0508 and maybe we can all get together and get this
bastard!!!!!!!!!!!!!!also i was never told all sales were final.i did what
this man asked and still got screwed, i should have kept the computer, but
that tells you how honest i am. i did what he asked and got screwed 2xs, but
this is a very valuable lesson!!!! me the dumb ass!!!! |

Complaint: We, too, were scammed along with so many others. In our case it
was a few hundred dollars that we were unable to recapture! This company
forges documents, changes signed documents with 'white out', and
FRAUDULANTLY charges credit cards!! Since our incident, I've had callers
state they have even gotten hold of their checking account numbers some how
and have STOLEN money from them. COUNT US IN ON ANY LAW SUITES AGAINST
THESE GUYS!!! They need to be SHUT DOWN and federally charged with fraud

Silcon Mobile Tech did everything mentioned above and more. We stopped

15 mos. BEWARE BE AFRAID!!

I sent in a complaint but haven’t seen it posted yet.
Not only did this company scam us, but outright STOLE. When we actually
got our money back (We stopped payment on a check – we had refused to
give any CC info to him). He has been cashing auto-checks at a
California bank MONTHLY in the amounts of 599 and 699 from our account.
I had baby #3 this past year and haven’t kept a close eye on things.
(yes I am firing myself) He has done this for over a year. UNREAL!

along. If we all work together we can get him. Silicon Mobile Tech is gone
and was setup as Superlaptops this company is also gone. But he is still
cashing forged checks and billing our cards. Name Dave Jan out of Cal. if

fraud that Silicon Mobile Technology has been committing!! We have just got
off the phone with our local FBI Agent and he will be forwarding info to the
FBI Office closest to Milpitas, CA. EVERYBODY CONTACT THEIR FBI AGENT
CLOSEST TO THEM AND DO THE SAME!! MAKE SURE TO TELL THEM ABOUT ALL THE
OTHERS NATIONWIDE DOING THE SAME!
Let's make them accountable for their Fraudulant Activities!!

Complaint: This is a complaint about Silicon Mobile Technologies and David
Jan. We are also a small company who has had $6817 withdrawn from our
business bank account between May 2004 and Sept 2004 at $1399 and $1310
pops. There was absolutely NO product involved!. I believe they got our
bank account information from a purchase we made from Silicon Top over 4
years earlier! My attempts to talk to anyone there were futile as they were
evasive telling me David would need to take care of it. So I went to
Network solutions and got David Jan's number from a whois on
superlaptops.com. He said he was David Jan in perfect english until I told
him what it was about. Then he suddenly could not understand English. I
threatened to "get" him somehow and he responded by taking down his website
and domain, turning off his cell etc. The company suddenly vanished. Bank
of America has done jack shit for me under Reg E and I had $528 in overdraft
charges after the first withdrawal! I am more than willing to be part of
any class action suit to go after these guys! |

Jason who works for them and booked my cruise told me that I could redeem my
points whenever I wanted and they would be credited to my credit card.
However when the time came-their story changed and now I can only get them
towards an outstanding balance on a cruise which I had to have paid off 90
days prior to my cruise. So I am out $800 because their employee gave false
informatio. This company was very rude and did not try in the least to help
me even though it was due to their employee telling me wrong information. I
will not let this go because I wouldn't have even booked the cruise with
this company if iI WASN'T GETTING $800 OFF. |

Complaint: This guy has been calling and e-mailing me constantly. He
claimed the Demo laptop was "free" at first, then he wanted me to fill out a
credit app. I thought this all smelled fishy so I searched his company name
on Google.com and this site popped up first. Glad to see the community is
aware of this guy's hijinx. Right now I think he's trying to pull his next
round of scams.. has anyone reported this guy to FTC, FBI, BBB or local
authorities yet? I should hope so... |

to me, but they also ran my credit card for chargesover a weeks time as to
not alert me to the charges. I filed a complaint with my bank along with
filing fraud charges with th e sherifs dept. and was able to get a refund

Complaint: SILICON MOBILE IS THE WORST COMPANY EVER. mine was the same style
thing. they charged me the 1298 i beleive. for my company. it's bogus. then
they had to get a bank account number or something along those lines.
anyways they ended up forging (or copying the owners handwriting) onto a
check and said it was ours. we tried telling them that we didn't want the
flipping thing. so he said ok send it back and we will cancel the charge but
it will still cost you a certain amount of restocking fee. it was rediculous.
all of this they didn't tell us was even in the cards. they had told us that
we would have a 90 day demo. it cost too much for us to hold onto, so we
were going to send it back when we discovered 1) the charge to the account
2) the low cost cheap equipment 3) and the amount of english our rep spoke
David Jan. all in all they ripped us off 3 or 4 times but weren't able to
find out about this till after the final "forced Purchase" anyways i read
your post and had to respond. |
